When I am retained to represent a claimant, the fee structure is contingent. There is a fee only when the claimant is found to be disabled by the Social Security Administration and awarded retroactive payment. Attorney fees for representation in Social Security disability cases are regulated, and must be approved by SSA. The amount of the fee, as of October 2022, is 25% of the claimant’s back pay not to exceed a total of $7200, and is subject to change at such times when SSA amends its attorney fee regulations.
